CHAPTER VII: MIXED GOVERNMENTS
第七章: 混合政体

 Strictly speaking, there is no such thing as a simple government.
厳密に言えば、単純な政府というものは存在しない。
An isolated ruler must have subordinate magistrates;
isolated (孤立した) [形] far away from other places, buildings, or people
孤立した支配者には、従属する行政官が必要である。
a popular government must have a head.
民主政には、長が必要である。
There is therefore, in the distribution of the executive power, always a gradation from the greater to the lesser number, with the difference that sometimes the greater number is dependent on the smaller, and sometimes the smaller on the greater.
gradation (段階) [名] a series of gradual changes
lesser (少数) [形] smaller in size or amount
sometimes (場合) [副] on some occasions or in some cases
smaller (少数) [形] smaller in size or amount
したがって、執行権の配分には、常に多数から少数への段階があり、多数が少数に依存する場合と、少数が多数に依存する場合とがある。

 Sometimes the distribution is equal, when either the constituent parts are in mutual dependence, as in the government of England, or the authority of each section is independent, but imperfect, as in Poland.

mutual dependence (相互依存) [名] a relationship in which each person or thing depends on the other
independent (独立) [形] not dependent on another for livelihood or subsistence
imperfect (不完全) [形] not perfect; having a defect or weakness
イギリス政府のように構成要素が相互に依存している場合や、ポーランドのように各部門の権限が独立しているが不完全な場合には、配分が平等になることもある。
This last form is bad; for it secures no unity in the government, and the State is left without a bond of union.
この最後の形態は悪い。なぜなら、政府の統一が確保されず、国家は連合の絆を失ってしまうからである。

 Is a simple or a mixed government the better?
simple (単一) [形] having only one part
単一政体と混合政体ではどちらが優れているか?
Political writers are always debating the question, which must be answered as we have already answered a question about all forms of government.

debate (議論する) [動] discuss or argue about (a subject)
政治評論家は常にこの問題について議論しているが、この問題は、すでにあらゆる政体について答えたように答えなければならない。

 Simple government is better in itself, just because it is simple.
単一政体は、単純であるというだけで、それ自体が優れている。
But when the executive power is not sufficiently dependent upon the legislative power, i.e. when the prince is more closely related to the Sovereign than the people to the prince, this lack of proportion must be cured by the division of the government;
sufficiently (十分に) [副] to a satisfactory degree
closely (密接に) [副] in a way that is very near or connected
related (関係する) [動] connected by blood or marriage
proportion (均衡) [名] a part or share in due or proper relation to the whole
cured (是正される) [動] to restore to health
しかし、執行権が立法権に十分に依存していない場合、つまり、君主が人民よりも主権者と密接に関係している場合、この不均衡は政府の分割によって是正されなければならない。
for all the parts have then no less authority over the subjects, while their division makes them all together less strong against the Sovereign.

them (それら) [代] the people or things previously mentioned
all together (全体的に) [副] as a whole
なぜなら、すべての部分が臣民に対して権限を持ち、分割によって主権者に対して全体的に弱くなるからである。

 The same disadvantage is also prevented by the appointment of intermediate magistrates, who leave the government entire, and have the effect only of balancing the two powers and maintaining their respective rights.

entire (丸ごと) [形] with no part left out; whole
balance (バランスをとる) [動] keep or put (something) in a state of equilibrium
同じ不利益は、政府を丸ごと任せ、二つの権力のバランスをとり、それぞれの権利を維持する効果しかない中間的な行政官の任命によっても防ぐことができる。
Government is then not mixed, but moderated.
mix (混合する) [動] combine or be combined
moderate (緩和する) [動] make or become less extreme, intense, rigorous, or violent
政府は混合されるのではなく、緩和される。

 The opposite disadvantages may be similarly cured, and, when the government is too lax, tribunals may be set up to concentrate it.
cure (是正する) [動] relieve of the symptoms of a disease or condition
lax (緩慢な) [形] not strict or severe
反対の不利益も同様に是正することができ、政府があまりにも緩慢な場合には、それを集中させるために裁判所を設立することができる。
This is done in all democracies.
これはすべての民主主義国家で行われている。
In the first case, the government is divided to make it weak;
最初のケースでは、政府は弱体化するために分割される。
in the second, to make it strong: for the maxima of both strength and weakness are found in simple governments, while the mixed forms result in a mean strength.

mixed (混合型) [形] combining two or more things
result (なる) [動] have a particular outcome
二つ目は、それを強くするためである。強さと弱さの両方の最大値は単純な政府に見出されるが、混合型は平均的な強さになる。
